A decision could come down at any day that may or may not pull down B.C.’s tough drinking and driving laws.
Acumen Law’s Paul Doroshenko, who launched a constitutional challenge against the current laws, says the final arguments have been made and now we wait for a decision.
If the courts rule for his side of the argument that the legislation is unconstitutional what does that mean for the laws of the land?
“Maybe the judge is going to say this entire scheme in its current iteration has to be turfed. May be they will give them some time to do it I don’t know. It will be interesting to see. If it is upheld then I can tell you it is not something that is going to inspire a whole lot of confidence in the justice system in B.C.”
Doroshenko says if the courts rule for his argument then it could also trigger retroactive compensation for everyone who challenged their drunk driving conviction.
