
A Kamloops man convicted for killing his friend in a Dallas RV Park two year ago will be sentenced on Friday.
A jury found Stephen Fraser guilty of second degree murder in December for the killing of Cody Foster in February of 2017. He has been in jail ever since
A second-degree murder conviction has a mandatory life sentence. In a court hearing today, the Crown has asked for Fraser to not be eligible for parole for 14 to 15 years – most significantly based on the “excessive violence” of the killing.
Crown prosecutor Alex Janse says Foster suffered 32 separate injuries when he was killed, including 17 stab wounds to the head, face and neck area. She says Foster was made vulnerable based on his friendship with Fraser. The two had were 30 years apart in age but had been friends for more than a year, and Janse says there was “an aspect of trust” that Fraser took advantage of when he killed Foster in his home, in attack she says was unprovoked.
The defense, while acknowledging “this was a brutal killing,”today asked for the minimum of 10 years before parole eligibility. Defense attorney Jay Michi pointed out prior to his second-degree murder conviction, Fraser lived a “quiet, unremarkable, law-abiding, pro-social life,” and says he is known to be intelligent, kind and compassionate by those close to him.
Justice Len Marchand will come down with a ruling at 10 a.m. Friday in Kamloops Supreme Court.
